Guest Policies

 

1.PROPERTY:  Home is rented for vacation purposes only. Check in time 4pm, Check out time 11am.

 

2. RATES: NIGHTLY RENTAL prices are quoted on a daily basis and do not include applicable tax and fees. A 12.5% occupancy tax and  a $65 process fee is applied  to all nightly bookings.. An optional non-refundable Security Deposit Waiver at the cost of $50 will be charged at the time of booking for nightly rentals. The Security Deposit Waiver waives your responsibility for accidental damage to the property itself up to $500. Anything above $500 in accidental damage will be charged to the credit card on file. The Security Deposit Waiver does NOT waive responsibility for intentional damage, neglect, pet damage, excessive cleaning or payment of fines. If you choose to opt out of the Security Deposit Waiver a $500 refundable Security Deposit will be required at time of booking and can be refunded within 14 days from departure if there are no damages to the home. A Security Deposit Waiver is not available for bookings of 30 days or more. Rates are subject to change without notice. A refundable Security Deposit is required at time of booking.

 

3. PAYMENTS:  NIGHTLY BOOKINGS: An advance rent deposit of $450 is required at time of booking. .A $65 process fee is applied to all nightly bookings. A credit card is required to be on file. We accept MC/Visa. If paying by check, it must be received  10 days prior to arrival.Balance due will be charged to the credit card on file 1-2 business days before arrival.

MONTHLY BOOKINGS: $2000 Security Deposit is required at time of booking. A $150 process fee is applied to all monthly rentals.If paying by check, it must be received  10 days prior to balance due date. Balance due will be charged in full 60 days before arrival. Occupant agrees to charges stated in the attached Financial Confirmation.

 

4.AUTHORIZED USE AND GUEST: The premises are for the sole use as a personal vacation residence by not more than allotted maximum occupancy. If the premises are used, in any way, by more guest than the maximum occupancy allotted, Occupant; (i)authorized guests and all others may be required to immediately leave the Premises or be removed from the Premises; (ii)Occupant is in breach of this contract and forfeits its right to return of any rent, fees, or security deposit paid. Home may have exterior security cameras. NO OUTSIDE NOISE AFTER 9 PM. 

 

5. SMOKING: No Smoking is allowed on the Premises at any time. 

 

6.PETS: Pets are allowed in designated homes only upon approval.. If you have brought a pet to a home designated Pet friendly there is a $15 per night  Pet Fee and the Pet Policy is required as part  of this agreement.. 

 

7. PARKING: Park all cars off street. No on-street parking is allowed.   

 

8. CONDITION OF THE PREMISES:  Occupant shall upon arrival, examine the Premises, all furniture, furnishings, appliances, fixtures, and landscaping, if any, and shall immediately report if any are not in operating condition or are in disrepair.(A). Mold Mildew. Mold and mildew both feed on moisture, so bathrooms, showers, laundry rooms, kitchens and other areas are where mold can incubate and grow. Moreover, houses near the ocean are one of the most conducive environments due to increase in humidity for mold to grow and prosper if not properly addressed. Despite being properly addressed by Scenic Coast Property Management’s cleaners, mold/mildew can and may appear during your stay. Its presence does not imply a “dirty,” unclean, or non-disinfected property. If it does appear during your stay, please contact us and we will take care of it as soon as practical. People with allergies, asthma, breathing conditions and immune conditions may be more sensitive to mold/mildew. By signing this rental agreement, you are acknowledging and accepting the inherent potential risks of the presence of mold and mildew when you rent a property near the ocean. CONDITION DOES NOT GIVE OCCUPANT THE RIGHT TO CANCEL THIS AGREEMENT OR RECEIVE ANY REFUND AT ALL.

 

9. MAINTENANCE: Occupant shall properly use, operate and safeguard the Premises including, if applicable, any landscaping, furniture, furnishings, appliances and all mechanical, electrical, gas and plumbing fixtures, and keep them clean and sanitary. Occupant shall notify Scenic Coast Property Management of any problem, malfunction or damage. Occupant shall pay for all repairs or replacements caused by occupant, guests  of Occupant, excluding ordinary wear and tear. Occupant shall pay for all damage to the Premises as a result of failure to report a problem, malfunction or damage in a timely manner. Occupant shall pay for repair of drain blockages or stoppages, unless caused by defective plumbing parts or tree roots invading sewer lines.

 

10. ALTERATIONS: Occupant shall not make any alterations in or about the Premises including, but not limited to, moving furniture, painting, wallpapering, adding or changing locks, placing signs, displays or exhibits, or using screws, fastening devices, large nails or adhesive materials.

 

11. ENTRY: Owner or Scenic Coast Property Management and agents have the right to enter the Premises, at any time for the purpose of making necessary or agreed repairs, or in case of emergency.

 

12. NO ASSIGNMENT OR SUBLETTING: Occupant shall not assign any interest in this Agreement or sublet any Part of these Premises.

 

13. UNAVAILABILITY: If for any reason, beyond the control of Owner or Management , the Premises is unavailable, Management  may substitute a comparable property or cancel this Agreement and  refund to Occupant all payments made.

 

14. CANCELLATION: NIGHTLY BOOKINGS: Free Cancellation up to 60 days before arrival. Cancellations made inside of 60 days before arrival the fee is $450. MONTHLY BOOKINGS: Cancellations made outside of 60 days the fee is $2000. Cancellations made inside of 60 days before arrival, only security deposit and cleaning fee will be refunded.

 

15 HOLDING OVER: Occupant agrees there shall be no holding over or late departure without prior approval.

 

16. RULES; REGULATIONS; NO COMMERCIAL USE: Occupant agrees to comply with any and all regulations that are at any time posted on the Premises or delivered to Occupant. Occupant shall not and shall ensure that all others shall not: (i) disturb, annoy, endanger, or interfere with any neighbors; (ii) use the Premises for any commercial or unlawful purpose including, but not limited to, using, manufacturing, selling, storing, or transporting illicit drugs or other contraband;(iii) violate any law or ordinance; or (iv) commit waste or nuisance on or about the Premises.

 

17. OCCUPANT’S OBLIGATIONS UPON TERMINATION OF OCCUPANCY: Upon termination of occupancy, Occupant shall:     1.Return to Mgmt all keys and garage remotes. A $10.00 fee will be charged for all lost keys. A $100.00 fee will be charged for lost remotes.2.Vacate the Premises and surrender to Management empty of all persons. 3.Vacate any/all parking and/or storage space. 4.Close and Lock all doors/windows. Turn off lights and appliances. 5.Turn down heat and make sure fireplace jets are off. 6.Clean BBQ if used. Wash dishes/ run dishwasher. 7.Leave beds unmade, do not launder bed linens or towels.

 

18. PERSONAL PROPERTY AND INJURY:

(A). Owner Insurance: Occupant’s or guests’ personal property, including vehicles, are not insured by Owner, Scenic Coast Property       Management, or if applicable, HOA, against loss or damage due to fire, theft, rain, water, vandalism, criminal or negligent acts of others or any other cause. Owner and Scenic Coast Property Management does not insure against personal injury to Occupant or guests.

(B). Occupant Insurance: Owner and Scenic Coast Property Management recommends that Occupant obtain insurance to protect Occupant or guest and their personal property from any loss.

(C). Indemnity and Hold Harmless: Occupant agrees to indemnify, defend, and hold harmless Owner and Scenic Coast Property      Management from all claims, disputes, litigation, judgements, costs and attorney fees resulting from loss, damage or injury to Occupant, Occupant’s guest or licensees or their personal property.

 

19. MEDIATION: Occupant agrees to mediate any dispute or claim arising out of this Agreement, or any resulting transaction, Before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among parties involved. 

 

20. MEGAN”S LAW DATABASE DISCLOSURE: Notice: Pursuant 5 to Section 290.46 of Penal Code, information about Specified registered sex offenders is made available to the public via an internet Web site maintained by the Department of Justice at www.meganslaw.ca.gov. Depending upon the offender’s criminal history, this information will indicate either the address at which the offender resides or the community of residence and Zip Code in which he or she resides. (Neither Owners nor Brokers, if any, are required to check this website. If Occupant wants further information, Occupant should obtain information directly from this website.)

 

21. TRANSIENT OCCUPANCY: Occupant is renting the Premises as a transient lodger for a number of days specified on Page 1 of this agreement from the Owner who retains full legal, possessory and access rights.

 

22. AGREEMENT:  Occupant acknowledges receipt of this Agreement, the Guest Policies, the Financial Confirmation, and if applicable; (i) the Pet Policy ; (ii) Spa/Hot Tub Policy; (iii) 30+ Day Additional Fee Disclosure, and agree to the terms and conditions.

 

 DISCLAIMER:  Scenic Coast Properties Management shall not be held responsible for damage or injury to Occupant/s or any other person/s - guest/s; Agent will not be held responsible for acts of theft, vandalism or other damages to Occupant/s or guest/s personal property that may occur on any property or any part thereof, or in common areas thereof. Occupant/s agree to hold agent and owner/s harmless for any claims of damage or injury no matter how caused.  Every effort will be made to honor your reservation, but please understand there are some situations beyond our control.   Should the property be unavailable for any reason, Scenic Coast Property Management reserves the right to relocate you to another similar property or refund your deposit.

 

ADDITIONAL MONTHLY FEE DISCLOSURE  30+ DAYS

 

A $2000 security deposit is required, and a credit card on file. The security deposit may be used for any damage to the premises, personal property, extra cleaning, cancelation or excessive use of utilities. Guest reponsible for Gas usage over $300 per month. Guest with electric cars will be charged an additional $200 for charging usage. Guest liability is not limited to $2000.00. 

 

Cambria is in a  drought. There is a heavy surcharge for over usage of water. If usage exceeds the 3 unit per month allocation, there will be a charge of $30 per additional unit.  A unit is equal to 728 gallons of water. We will record the water meter readings upon arrival and departure. Instructions on how to read the water meter are attached. Please try to conserve our precious resource WATER.

Pet Policy

  1. Pets are required to have all current vaccinations (including Parvo and Lyme disease)
  2. Pets must be Flea-Free, and on a flea control program.
  3. Pets will not be left unattended in or outside of the rental home.
  4. Pets will be kept on a leash outside of the home.
  5. Pet must have current tags.
  6. Do not allow pets on furniture. If your pet sleeps on the bed, you are required to use a protective sheet. If you fail to do this you will be charged to clean the bedspread/comforter.
  7. No excessive barking is allowed in or outside the property.
  8. Be sure to pick after your dog in the yard.
  9. Scenic Coast Property Management and Homeowners will not be held liable for any injuries sustained by any person or animal as a result of the guest’s pet’s behavior.
